He has the keys to your van and is within his rights to keep it in his lockup until the bill for the work he has done is paid in full.
no mechanic can hold your vehicle it's the law they don't legally own the vehicle

I once went with a friend to bmw to collect his car coz they charged 3 times there original price they called the police who did come but think to keep the peace.they said wasn't a police matter its civil would have to be dealt with through legal channels they made them hand the keys over we drove out 20 min later

 
Me personally I'd go and get the van back no matter what works been done ,I hate giving anyone my money if I'm not treated right
To right!!! best off gave him benefit of doubt after first ordeal.ive never ripped anyone off in my life but I wont be treated like mug how would he like it if I take his precious snap off tools!!!!!wait there's a idea

 
If it was me I would take the parts back out if someone refused to pay the bill /emoticons/biggrin.png

There was a builder round r way who fitted a new roof then didn't get paid but was told he couldn't remove it so he went and smashed the whole roof it made the national news!!!

No one can legally keep ur possessions spec car if it's owned by you

 
It sound to me like you have rubbed him up the wrong way to start with.

Now you have said you're not doing to pay him. What a nice chap you are.

A bailment comes about when the garage voluntarily accepts possession of a customer’s car (or van or bike or any other type of vehicle) such as when a customer brings his car in for repair. English law does not require a contract between the garage and its customer for a bailment to arise.

If the garage carries out repairs and this results in an improvement to the car (as opposed to its current condition merely being maintained), the garage is entitled to retain possession of the car until the customer has paid for the repairs (this entitlement being known as a “lien”). Once the customer has paid, the lien is lost and the garage must return the car.

Therefore, all things being equal, if a customer brings a car to a garage for repair, demands its return after it has been repaired but refuses to pay for the works, then, even if the garage’s terms and conditions don’t apply (for whatever reason), the garage still has the right to retain possession of the vehicle until the customer pays for the repairs by reason of the law of bailment.

 
No. It's a civil matter. There should be no police involvement. If as you describe the officers got your keys back they were acting outside of their authority, and just tried to do you a favour. That could have caused them much trouble if a complaint was received from the garage.

They could have just said 'you need to get a lawyer'

 
Little update rained off today!!ive gone and fetched my van back the system is bolted in and but no wiring done

I explained the inconvenience this caused he apologised and said doesn't matter about paying for the work so far and had even adjusted the rear door

He explained he fought coz I had another van wasn't in a rush even tho he did say 3 days anyway that's the way to do business

So smurf if like you implied I'm in the wrong and not a nice guy then why did he apoligize

Moral is in business well mine is keep ur customers happy and do the job you said you would and ur business will never suffer
