no its down to the customer. as they are the employer of the window cleaning, it is down to them to make sure ladders are safe and the person is capable to use them!How can a custie be prosecuted if a person falls off a ladder. Surely it's down to the windy?
basicly yer thats right! at the end of the day they are the employer!I suppose that would also work the other way round RC with wfp if theres an accident, if a custie hasn't checked the pole, brush, hoses, electrical system, health and capabilities of windie (ie can he actually hold that pole up there without dropping it on someone) and if they haven't checked that a risk assessment etc hasn't been carried out.

its worse for us WFP guys as we are ment to do so much more to protect the area around us with cones and tape etc etc!Thought so mate cheers!
WFP guys always seem to be playing those cards but I don't think they realise that laws like that work both ways and it really is worth knowing.
i have roped of sections and layed out signs for jobs where there are public about.Yeah stuff like roping off as far as ya pole would reach if it fell must be a sphere ache but again how many domestic wfp guys do that or anything like it come to think of it so really who's the farthest away from the letter of the law
Just finding it interesting by the way, I'm getting my own stuff sorted for pub I got to do as it's a really busy junction and I'm doing upstairs wfp and taking advice from you and others here about the safety side of it.
not really coz if you read the HSE on it, it discourages the use of ladders and to use other means of cleaning like wfp etc!Maybe us trad guys are nearer to the letter of the law then the wfp guys lol. Have never seen a wfp guy with cones & that out and there hoses have been all over the road path the lot. Mind you if you did everything that you are Spose to do you would prob clean 1 house a day lol.
