So do you not need it to pop up in your face, I thought the eu cookie law meant you had to have it plainly visible and a visitor must not have to scroll or read through the content before getting to the cookie statement link??
It's an incredibly grey area! You have what's called "implied consent" which means that as long as you tell people that your site uses cookies, then you have their consent. Realistically by the time someone is on your website, regardless of whether they're at the top or bottom of the page, the cookies have already loaded! The whole thing's a bit of a joke really but as long as you're seen to have made an attempt at compliance, then you're OK.

On some sites I use statcounter code - those sites have cookie policys.

Your mention of 3rd party cookies being used without me realising it is concerning though,. is there any other way this could happen?

 
You need to look at any Javascript that's being used on the website. If you know how the scripts work, you'll know whether they use cookies or not. If you wrote the script yourself then you'll know the answer to this, otherwise you need to consult the developer that made it.

 
Right,... I must say I use LOADS of scripts that I didn't write - lightbox, slider, superfish, jquery etc etc - - I will have to do some research,...

 
Just done a bit of reading - aparently if you have a FB or twitter plugin on your website it can use cookies too,...

Those javascript libraries you mentioned don't need cookies to work so you should be fine.

You can easily find out if you website is using cookies in Chrome by navigating to chrome://chrome/settings/ -> click show advanced settings at bottom -> Content settings button -> Cookies and site data -> then you can search for your website

The cookie law is a bit silly but it is supposed to target websites that do a lot of heavy tracking for marketing purposes, the kind of sites that has more adverts than content. Just sticking a small note saying the site may use cookies for usability purposes should be good enough.
