Use the freedom of information act to find out when there was an inspection last done of that road where the pot hole was, you can then use the freedome of information act to find out how often that road has to be inspected. If that time scale doesnt fit they have to pay out. Read that from the paperThey will pay out usually, "act of god" hasn't been allowed for years on private car policies so doubt they can use it on a commercial policy.
The council ahaha don't even bother. Unless you can prove the council knew it was growing over the road, then your jut wasting time.
