Employment law says you can self certificate for the first 7 days so don't need to get a doctors noteAsk him for a 'sicknote' from his Doctor.....and when he returns to work after his lazy-day-off (sickday I mean...honest /emoticons/wink.png) tell him that in your opinion, that he still seems 'a bit under the weather' and as you're a caring employer, you need a 'fit to return work certificate' from his Doctor.

thing is iv invested a lot of time in getting my workforce up to scratch and to get rid wont help me in the short term not now im deep in it with a big load ,run up to xmas etc . theres precious little time to train up a novice

If he hasn't worked for you that long you could always claim downsizing and make him redundant?
Depends how long he has worked there, severance pay is only after quite awhile.Then he will be entitled to redundancy severance pay plus any holiday pay due etc
You also have to be able to prove that you are downsizing and not just making it up to get rid of someone then get someone else to do his job straight after.
